Key to Certificates
An acknowledgement is the Notary's certification that the signer appeared before the Notary, was positively identifed by the Notary, and acknowledged by the Notary as having signed the document of his or her own free well. An acknowledgment certificte is usually distingished by the words "personally appear" and "acknowledged."
A jurat is the Notary's confirmation that the signer signed the document in the Notary's presence and took an oath or affirmation from the Notary verifying the truthfulness of the statements in the document Jurat certificates usually contain the phrase "subscribed and sworn."
Different Strokes
Every state has different notarization rules, so don't panic if you encounter out-of-state wording or directions at variance with what you're used to. The important thing to remember is to follow your own state's rules, even if the document will be filed in another state.
Don't leave the door open for Identity Theft:
1. Never accept a birth certificate as identification.
2. Never accept a photocopy of an identification document.
3. Personal appearance is crucial. Without personal appearance by the signer, even ligitimate identification is useless.
4. Watch for discrepancies between a signature and ID.
5. Do not accept temporary license.
By following these steps, a Notary not only safeguards signer from identity theft, he or she also takes reasonable care to protect against liability.
