....Mr. Xu, 30, the teacher, was running in the Haidian district of Beijing, for a seat representing the university where he lectured in law. He said nearly 300 candidates, many of them self-nominated, ran in an open primary in late November, and the top vote-getters advanced to the election. Students, attracted by his idealism, campaigned for him, while Mr. Xu posted information about himself on a Web site and spoke at campus events.

"In joining the election," Mr. Xu said, "it's about advancing democracy and the rule of law in China."

Mr. Xu, who has a doctorate in law, said he sought office as part of his larger commitment to expand democracy and the rule of law in China. Earlier this year, he helped defend Sun Dawu, the rural banker who had earned a reputation as a Robin Hood but was arrested on charges that he had run an illegal bank. Mr. Sun was eventually convicted but released.

Mr. Xu also helped overturn an unpopular law that allowed the police to detain people traveling without residence permits. After the police in Guangdong Province detained and beat a person to death, Mr. Xu and two other legal schools petitioned the nation's top legislature to review the constitutionality of the detention law, which was later abolished.

His victory gives him a modest position in one of the lower rungs of China's layered government, far below the National People's Congress. But he already has plans to push for improving laws governing forced relocations of apartment dwellers, which is a lively topic in big cities.

"I can feel the changes happening in China myself from the things I've been involved in over the past year," Mr. Xu said....

....In fact, as we can see from the words of Xushui County officials, Sun Dawu does not even constitute a “private financing group.?He wasn’t building up a money hoard or establishing a power base; rather, his borrowings were a form of public welfare and a means of keeping money flowing into local production. Of course, there are many things that are reasonable and desirable but not necessarily legal, and this writer is not familiar with the relevant laws, nor does he have a thorough understanding of Sun Dawu’s conglomerate, and is therefore unable to comment on the legality of what Sun did. But if the situation’s results are hard to evaluate, its antecedents are not:Sun Dawu provided employment to a large numbers of villagers in his agricultural enterprises over the past 18 years, he didn’t speculate in the stock market or get involved in real estate opportunism, and his business was not in a perilous financial condition. If he had been able to borrow money through the usual channels, would he have needed to borrow money from his employees and fellow villagers? In a situation of financial monopoly, in which villagers are not even allowed to borrow their own money, which instead is transferred to the cities to support urban billionaires, the funds that the Sun Dawus of China can’t borrow are instead dropped into the hands of the Zhou Zhengyis. By leveraging their guanxi,these real estate-financial sharks can get all of the property and funding they want; the land they get is in massive lots, and the funding they receive is in the billions.The funds are invested in real estate, and the residents of that property are forced from their homes.In comparison, how can someone like Sun Dawu, who struggles without loans for more than ten years and runs afoul of the law because of private loans, compete with someonelike Zhou Zhengyi? The fact is, the more that routine loans required by China’s Sun Dawus are refused, the more money is available to the Zhou Zhengyis to nourish their guanxi, and the more “relationship capital?they build up, the more profit opportunities they gain. In an open credit system operating in a market ruled by law, if most businesses could easily obtain financing, what good would Zhou Zhengyi’s guanxi be? But in another kind of “market,?it is possible to wave a magic wand of power and declare, “If I say you’re poor, you’re poor, even if you weren’t to start with, and if I let you get rich, you get rich,even if you weren’t to start with.?How can anyone be com-fortable with this divergence between rich and poor? As it is in finance, so it is with real estate, be it in the cities or in the villages....

Hu, Wen Make Their Mark in Surprisingly Short Time

....Another case casting good light on the Hu-Wen leadership involved Mr Sun Dawu, a Hebei entrepreneur detained in May on charges of illegally accepting financial deposits amounting to 13 million yuan (S$2.7 million). As he was a known critic of the government and had stood up to the authorities in fighting for the less privileged, people speculated that his arrest was politically motivated.

In the end, Mr Sun's sentence was surprisingly light. He was given a three-year sentence, suspended for four years and was set free shortly after the trial. Unlike the labourer's case, this incident did not result in any concrete policy change. But it reflected the government's willingness to be more responsive to the grievances of the people....


Professor Yao Jianfu Lectured on the Issue of Agriculture, Rural Development and Farmers

Peking University, Beijing, Feb 26th 2004: professor Yao Jianfu from Harvard University gave a speech on the problem of agriculture, rural developement and farmers in Peking University. Different from the process of ordinary speeches professor Yao Jianfu began with listening to the questions of the audiences. According to these widely concerned questions professor Yao focused his speech on the following three points: the modernization of agriculture, the rights that farmers deserved to, then comments on the case of Sun Dawu.


Last but not least, professor Yao commented on the case of Sun Dawu which had become the center of public attention. In his opinion, the society is lack of trust which is highly regarded by Sun Dawu. What is more, the enterprise of Sun Dawu helps to solve the problem of excess labors in countries. It is the disaccord development of market in rural areas that leads to the tragedy of Sun Dawu.

Ill Gotten Gains

On January 2, a highly controversial document was passed into law by the local government in Hebei Province. The paper, drafted by the Hebei provincial Committee of Politics and Legal Affairs, was titled Decisions Concerning Creation by Legal Department for a Better Socialist Market-oriented Economic System. The ensuing uproar centered around the seventh item in the paper which stipulated that criminal behavior by private businesses could only be prosecuted within a given period. Even if litigation is brought during this time, the judgment must take into account the attitude of the criminals and whether they show due penance.

  11月1日,河北省徐水县。85岁的刘凤兰在家里一大早就心神不宁,一会儿坐到炕沿上,一会又挪到院子口向远方张望:她儿子棗?9岁的河北大午集团董事长孙大午自今年5月27日被逮捕后,再没见过母亲的面。
  在被羁押近半年后,孙大午被地方法院以?#38750;法吸收公众存款罪?#21028;处3年有期徒刑,缓刑4年,定于是日释放。
  这天也是孙大午父亲孙凯的生日,全家人都在忙活着饭菜,谁也不怎么说话。作为现场惟一的记者,我甚至不忍旁观这次压抑而酸楚的家宴。
  突然,家门口传来哭喊棗棑大午回来了!?  这也是记者第一次见到孙大午。半年的牢狱生活,他比照片上瘦了些,理了个寸头,白发出来了,但看起来精神尚好。
  亲人们把孙大午围在了中间,哭作一团。
  孙大午没落泪,看起来很镇定,只是眼圈红了一下。刘凤兰抱着儿子说:?#23567;子,告诉你,你妈没哭,你妈相信你能出来。?  坐下来后,杜润生、保育钧等人专程过来看他,他有些沉默,只是一杯接一杯喝酒,菜几乎都没动。而他家人告诉记者,原先他曾戒酒多年。
  不断有人进来敬酒,端起酒杯就掉泪,连人高马大的男人也不例外。隔壁和外面院子里,慢慢围聚了一大群人,越来越多,也不进来,只是在外面抹眼泪。
  一个食堂老师傅带着哭腔说:?#20320;走了5个月,咋跟5年一样?!?  有人问到了看守
