Some of us made some bad decisions when we were young and we broke the law. We are having to pay for it for the rest of our lives regargless of the sentence we were given. The State of Texas is enacting more and more laws against anyone with a criminal background regardless of how long ago it was, regardless of the circumstances, and regardless of what we have accomplished since then.
The most recent law I have been informed about by a potential employer went into effect September of 2003. It was HB 705, entitled "Relating to liability of in-home service companies and residential delivery companies for negligent hiring," authored by Representative Burt Solomons, District 65, Denton County, Carrollton, TX. This law is having a direct effect on those of us with a felony conviction. Employers are now being held directly liable by law for the people who choose to continue to commit crime. Now employers are just passing over anyone with a conviction without looking at their past record.
I am a Journeyman Plumber licensed by the State of Texas since 2001. My crime occurred in 1994. I was employed by the same company for 5 years without any trouble whatsoever. None of that matters now because of this law. Employers are passing me over without a thought. I am finding it very difficult and stressful to find employment with a decent company. And my kids are also suffering as a result. I am sure that I am not the only one being affected by this legislation and the continued laws that are effectively outlawing certain citizens.
Our US and Texas Constitution provides for no cruel or unusual punishments, yet we are being cruelly punished forever even after we have paid our dues and are trying our best to be productive citizens.
Our Texas Constitution says that "no citizen shall be outlawed" but the Texas legislature is effectively doing this by passing these laws.

No citizen shall be outlawed. No person shall be transported out of the State for any offense committed within the same. This section does not prohibit an agreement with another state providing for the confinement of inmates of this State in the penal or correctional facilities of that state.

We need to utilize the rights we have in order stop the wave of losing rights. Nothing will change unless we all do our part to make our voices heard.

Find out who your local representatives are and let them know how you feel about this type of legislation. Let them know how much they are hurting families.
