Why Employment Related Claims Are Increasing
These two websites > http://www.lawyersusaonline.com/index.cfm/archive/view/id/430265 and http://www.usatoday.com/news/religion/2007-10-13-charges_N.htm inform us that employment discrimination (harassment), religious, and other claims are on the rise. Is the rising economy problem, or the low employment-hiring situation the blame? In all honesty, if no discrimination, harassment, or other form of "bullying" has occurred, there can be no substance to such claims.
Investigating and processing claims can be financially draining and time consuming. In most cases, employers allow situations to get out of hand. An employee who is "brushed off" may have no choice but to seek alternate representation.
Like most people, working parents and grandparents raised me. We are Bible believing people. We're not perfect, but we do believe in doing a good job. My father would have a heart attack while working. When the pain stopped, he'd try to continue working. My grandfather was upset that old age prevented him from working. My mother served the Government for 35 years before retiring. Much time and money was invested in me to be a good worker.
Things changed between 1995-1998. Many employers no longer cared about employee benefits. One employer unjustly terminated me (which the State investigated and agreed), and refused to pay certain wages. Fortunately the State investigated and the employer paid those back wages. Between 2003 and 2006 two different female managers bullied me. One was an office manager. She had a sign that read, "I'm The Head Bit*h" above her desk. This office manager bullied me, and eventually fired me. The State investigated. Fortunately, this office manager admitted that I had done nothing wrong. She just didn't "like" me (in other words, she was just a bully). Another female manager (supervisor) bullied me at another job. Her bullying disrupted a great relationship that I had with a temporary staffing agency.
These are just some of the many cases where I was bullied, harassed and discriminated against. In some cases, the work place seems to lack the professionalism necessary for success. Discrimination works well in isolated cases. Management may be able to unjustly "label" an employee. Yet when a lawyer or the State investigates, an entirely different "truth" is revealed. I am happy that the State Department of Labor and Wage and Hour have justly reviewed my cases. It's a horrible feeling to be "bullied", fired, and slandered.
The State should be able to review employment locations. Employees should be able to fill out “job environment” surveys. Another idea is to have an unbiased "Human Resources" department. Its job would be to resolve situations before unjust terminations occurred.
It's sad that the State can be "caught" up in a web woven by employers. Employers should be held responsible for the treatment of their employees. At some point (especially when a person can't find another job, their health worsens, or when the economy is suffering) an employee will have no choice but to seek alternative means of protection.
Professionalism is the answer. There used to be a time when Human Resources intervened. There used to be a time when written warnings and evaluations were given. There was a time when management could not just yell or accuse without merit. "Closed doors" were used to handle matters. These times seem to be "gone". We seem to be entering an age where employees see no chance of fairness or longevity. Thus they seek alternate means to deal with life's uncertainties.
