Wording of Deposit Receipt From Rural Estates Dated 30th July 2007.
I Antonio Symonowicz have received a HOLDING deposit, from Mr & Mrs Lambert, to TAKE OFF the market, property Ref No MNT229-Molino Posadas Nuevas in Adamuz Cordoba.
Present owner Snr Antonio L**** T******* N.I.F. **.***.***-K
Total price for the molino 225.000 euros - 6.000 euros= 219.000 BALANCE to be paid at the signing notario. Date to be confirmed AFTER the segregation has been passed, ALSO the sale of the property in the uk.
Jobs and items included in the selling price are as follows;-
Segregation 35.000m2 land.
Septic tank-10 persons.
Sondeo minus the submersible pump.
Level the main drive.
Level front car parking area.
Both of our signiatures added here.
We had been looking for the right Spanish property for several years & thought we had found it through Antonio Symonowicz of Rural Estates, Montoro, Cordoba.
We viewed the property & after careful consideration decided to buy & handed over £4,000.00 as a "holding deposit" (I have to say, against the advice of our Spanish solicitor), as we were determined to buy this one & we had been very careful to check all the paperwork through two solicitors.
Who could have known that having come home & put our house on the market,in order to finance the purchase, that the market would immediately go flat, delaying the whole process.
The agent, who we began to trust less & less for numerous reasons, wanted us to go out to pay a further deposit after the land segregation (all costs included in the sale price) had been done by his solicitor, who he had persuaded us to use.
As Mr Symonowicz lost our confidence & trust, we decided not to use his solicitor after all because we realised that we would be paying these charges in the total fees! Needless to say, the land segregation was never done. The very next day the "RESERVED" sign was removed from "our" property on Rural Estates website. Shortly after this "our dreamhome" was "For Sale" again at a higher price & subsequently sold to someone else.
Another reason we lost faith in him; The copy of our receipt above, says that the pump for the bore hole (sondeo) is not included, but we found out from the seller that it was included!
You may find this hard to believe but Mr Antonio Symonowicz of Rural Estates refused to return our £4,000.00 blaming both the vendor & ourselves for the outcome, he of course being the innocent party, "just stuck in the middle", according to one e-mail (with £2,000.00 of our money, having given half to the seller, he says).
Does this sound like the "Compassionate relocater" that Mr Symonowicz describes himself as!
I would advise anybody who wants to buy property in Spain to be very careful if they come across this person in their search. He is very persuasive & as he told us, quite openly, "I am always thinking of ways to make money" (like the 1,000.00 euro's he wanted for the pump mentioned earlier). He also told us more than once, "I can manipulate the Spanish very easily".
Be careful as manipulation can be very subtle!
If you happen to read this Mr Symonowicz, please note that you were given every opportunity to do the right & honest thing by returning our money. You will be hearing from our solicitor, as promised, in due course.
