Did you know that a CCJ can be removed (Set Aside) paid or unpaid?. It does not matter if the debt is still outstanding or if it has been settled 3 years ago, your rights remain the same. You have a legal right to challenge that judgment if you feel its placement be incorrect.
The CCJ is just the beginning. A Creditor has the right to enforce the judgment. This means that if you have been taken to court and a judgment was awarded to the creditor and you have still not paid, they can enforce it. This can be done in a number of ways.
1/ An attachment Of Earnings through your employer (PAYE ONLY)
This can be very embarrassing.
(Self-employed are exempt form this)
2/ They can apply to have the debt attached to your property as
secured Interest.
This means that on the sale of your property they will receive
The money owed to them, first.
3/ They can apply for a possession order to remove your shattles.
This would be a bailiff visit to your home.
4/ They can apply to the court for an oral examination of your
ability to pay the debt.
Because the Creditor has not contacted you for a few months or even a year does not mean you have got away with paying the debt. You will infact be on the Creditors Debtor list. Do not be fooled into thinking that after a period of time the debt will die. This is not true. Only the creditor has the power to right off the debt. If this was to happen, your credit file would say written off and the amount written off in £'s!.
This is worse than a CCJ because it cannot be removed....
So why risk putting yourself through all of the above when you can fix your problems within 4 weeks.
