CHANCE FOR NEW LIFE TURNS INTO ONE FATHERS LEGAL NIGHTMARE
I feel the people deserve to hear a true story
July 03 we moved to VA
Aug 03 We find out we are expecting our second child and find a home of our own.
Sept 04 we moved into our new home life is good…or.... So I think!!!!!!
Oct 6, 03 I get home from work (14 hrs)(My wife does not work)She wanted to go to Wal Mart. So we went then we return home I was very tired. (The next statement can be verified by her written statement given to the Police by her) My wife told me to do the dishes it was my turn, I said okay but I need a nap first. I then layed down she got very angry that I was trying to sleep, instead of doing the dishes waking me up several times. I threw dishes into trashcan.(none were broken ) I laid back down she got even more angry. When I again fell asleep she then threw hot soapy water into my face (causing severe eye irrational) I got upset yelled at her. She ran then into the bedroom breaking the door off the hinges and falls on her rear and bruises her arm on the fuse box door. She then leaves and calls cops. Next thing I know I am being arrested and charged with assault
Oct 10,03 My wife files a protection order alleging abuse and asking for custody of our child
Nov18 .04 My wife files for custody on the grounds of alleged abuse
Nov 20, 03 Protection order was denied by the courts on it’s own merits
Nov 24, 03 My wife was found living with a man just released from prison for a violent crime against a minor child (MEGANS LAW)(OUR SON IS WITH HER!! SHE LEFT OUR SON ALONE WITH THIS MAN ACCORDING TO MEDICAL RECORDS )
Dec 4,03 Courts grant me partial custody of my son and allow her a daily phone call with our 18-month-old child
Dec 6,03 I pick up my son to return home He has severe eye infection
Dec 11,03 Trial for assault continued (My wife does not show up)
Dec 23,03 Courts grant me custody of my son The mother is put on supervised visits.
Jan 06 Trial in VA for assault charge, Courts put a continuance of charges and reschedule till Jan 6, 06
Feb 10 04 I by informed by my lawyer that my wife has called VA alleging harassing phone calls.
Feb13, 04 I tape phone conversation between the childs mother and myself were she denies calling VA and tells my to call any time I want I am not bothering her
Feb 17, 04 Custody conferences in Pa her lawyer presents fax from Va stating I was being charged for harassment by the childs mother
March 4,04 My wife gives birth to our second child I was never notified.
March 15, 04 The Mother again files a protection order alleging abuse asking courts grant her custody of both our minor children I informed my wife of the baby bite on our son (Gave her certified letter from child care providor as to when ,where and how this happened)
March 23,04 Courts again deny her a protection order on it’s own merits, but give her partial custody on a every other week basis. (Due to this my child care provider had to testify( IN PA ) how my son was bitten by her child.) After this she is no longer willing to watch my son.Told me the nut I married was my problem and she is not going to go through this every time the child get a bump or bruise.
On or about April 20,04 I am notified that the newborn is hospitalized on allegations of abuse or neglect and advised not to return the oldest child to the mother for her next visit. I am also notified that the newborn has another man named as the father on his Birth certificate
May 27,04 Hearing for harassment held in VA I was found not guilty.
June 15, 04 Courts grant Mother supervised visit with oldest child. I must transport child to these visits. Infant is in foster care. During the visits to Pa my sons mother spent total $3.75 on her son while I absorbed all the cost of transportation 754 miles round trip
Sept16,2004 Custody conferance held Mother remains on supervised visits But she must come to Va for every other visit. Youngest son remains in foster care.
I would like to take the time to thank my parents, and all those who have beleived in me and helped by writing letters to the right people.I also want to thank Karen from FACE because without her help this may not have turned out in the best interest of my son. The emotional cost has been great and the ones that have been hurt the most are my children.
