Cobb County Real Estate Scam Against Seniors


Judge Adele Grubbs, Cobb County Superior Court overrules the Probate court, ignored a last will and testament and two executors to liquidate the land and homes of two senior U.S.Army veterans to satisfy the plaintiff and star witness, both having donated to her electoral campaign.

Land and homes belonging to the two seniors has been in our family since 1934. Taxes were paid to Cobb County for 49 years. They were approached on several occasions by a Marietta real estate owner (who also happens to be the father in law of the plaintiff), who made low price bids to purchase the property. After refusing to accept the low bids, the plaintiff and the real estate/in law used their knowledge to convince the executors/owners that the only way to sell the property for top value was to petition the City of Austell to rezone the property. They insisted that all the property must be combined into one deed in order to rezone. The owners/executors agreed to combine their deeds, contingent upon the rezoning. Once the deeds were combined, the prosecution sued the two seniors for the immediate sell and liquidation of their homes and land. The Cobb County Probate Court ruled the contracts void and the deeds be returned to original form after no zoning attempt was made and the contract expired. The real estate con man continued to offer low price bids for the property while the plaintiff made way to ignore the ruling of the Probate Court, and ignore mediation which placed the case into the Superior Court of Cobb County.

Judge Adele Grubbs ruled that the expired contract, the combined deed and the drawing of the property that the star witness (real estate brother in law) was enough to rule that the seniors be removed from their homes, and the houses and land sold. Before any money can go to the owners for their land and homes, deductions are to be made to pay the court, court receiver, court receivers attorney, real estate agent and fees. This ruling by Judge Grubbs was done without a licensed survey, without an impartial licensed appraisal, without following the will of the deceased, without the consent of the executors, and without consulting the Probate Courts ruling. The judge used an expired, incomplete copy of a contract which stated "after 90 days, if either party is not satisfied then no further obligation is required" which expired in 1997. The judge also used the real estate company drawing like it were a survey which it is not.

We have now become aware that the real estate/brother in law, has had a side deal with Cobb County to purchase this land for a county park, explaining the push for the combined deeds, the low cut bids, the contributions to Judge Grubbs campaign, and the eventual ruling of Judge Grubbs to allow this con game and senior rip off to occur. The land and home that my family owned prior to the expired rejected contract will not be returned, will not be compensated for, will not be replaced. We have had our house and land stolen right out from under us with the blessing of Judge Grubbs.

I would like to mention when this came upon the Superior Court docket, the case was not assigned to Grubbs but another judge. The plaintiff called the court saying he was at the hospital having a heart attack. The case was rescheduled, which conveniently placed Judge Grubbs presiding. After contacting the hospital, our family found out that the plaintiff did not have a stroke or heart attack as claimed, and was not admitted to the hospital but sent home that day. This was a common scam to have the case rescheduled to obtain the judge sympathetic to the plaintiff. This judge allowed the expert witness/brother in law/real estate con man to testify to the flood plain, property value, access, and size of our property and homes without so much as stepping foot inside. Our seniors are being removed from land and homes paid for by them, without a survey and without anything other than the real estate projected development drawing.

The real estate/star witness has now placed another low price bid on our property to the courts. We are told that the property must be surveyed, marketed and sold to the highest bidder. However, no attempt has been made by Cobb County Court to market, advertise or sell this property to anyone other than ....yes, you guessed it, the real estate/brother in law/expert witness/campain donator/friend of the judge/con man. Cobb County has apparently been working with this crook for over 10 years to obtain our property and has no intentions of paying the owners for it.
