SHOW AKITA SALES CONTRACT

REGISTRATION
AKC registration application papers will be transferred to the Buyer upon full payment of cost of Akita and within 30 days of delivery of the Akita. The Akita shall have FULL AKC Registration.
COLD MOUNTAIN prefix will be used on AKC Registered name.
Akita will be AKC registered by 5 months of age.
Copy of AKC registration papers will be sent to Seller. ________ initial

HEALTH
Seller certifies that the Akita is in good health.
During the following health exam the Akita was free of health defect or disease:

Health records including vaccines & wormings will accompany the Akita. .
Buyer may return the Akita for a refund of the purchase price,less the deposit, within 72 hours of delivery of the Akita.
Return of Akita will be at Buyer's expense.
Within this 72 hour time period at the Buyer's expense, buyer will have the Akita examined by a veterinarian. _______ initial

QUARANTINE
Buyer agrees that,
The Akita shall not be taken into areas potentially hosting Parvo or other infectious diseases for two (2) full weeks after puppy has been delivered to Buyer. This includes but is not limited to hiking trails, dog parks, fun matches, dog shows, doggie daycare centers, training centers, and/or any areas where large numbers of dogs are known to congregate.
If the Akita is being transferred via auto to it's new home-it is the full responsibility of Buyer to insure that the Akita is not entering areas where Parvo or other infectious diseases is active.
This information can be found by calling Emergency Animal Care Centers in the areas where puppy will be visiting during transport. Such Centers will be able to reveal if Parvo or other infectious diseases are a problem in that area and how many cases are typical of that season. Such Centers will reveal which areas in a certain County are known to be creating active Parvo or other infectious disease cases (including Buyer's OWN County). _______ initial

HEALTH GUARANTEE
Seller guarantees that between the ages of 24-26 months, the Akita will be certified free of hip dysplasia by the OFA and free of eye disease by a veterinary opthamologist as so registered by CERF.
Written documentation proving the diagnosis through OFA and/or CERF will be provided to the Seller. _________ initial

SHOW QUALITY
This is a SHOW QUALITY Akita
1)The Akita has none of the following disqualifying faults (Akitas)
a) Drop or broken ears
b) Sickle or uncurled tail
c) Undescended testicles in dog
d) Under size (23 inches bitch and 25 inches dog)
e) Noticeably undershot/overshot bite
f) Butterfly nose or total lack of pigment __________ initial

SHOW EXHIBIT
Buyer agrees to prepare this Akita to be exhibited in AKC Dog shows.
Buyer agrees to actively pursue the award of AKC Champion of Record with this Akita.
Buyer shall make a good faith effort to exhibit the Akita at Dog Shows.
Buyer is responsible for all show expenses including entries and handler fees. _______ initial

SHOW QUALITY GUARANTEE
Seller guarantees that this Akita is of show quality. Show quality meaning that at maturity, the Akita is free of disqualifying faults as specified by the breed standard and, further, that the Akita has the potential to obtain points towards and/or attain the award of AKC Champion of Record. Maturity is the period from 6 months of age to 2 years of age or until the Akita becomes a Champion of Record, whichever comes first. _________ initial

BREEDING CONDITIONS
Buyer agrees Akita will NOT be spayed or neutered. Should a situation arise requiring that this Akita to be altered, and it is not determined to be a life saving emergency, Seller must be given the opportunity to fully evaluate or have this Akita evaluated by an approved representative before said Akita will be altered.
No breeding of the Akita shall be done until the Akita has obtained "normal" hip certification by the Orthopedic Foundation for Animals (hereinafter, "OFA") and the Canine Eye Registration Foundation (hereinafter, "CERF"), nor shall any partner not so certified be used for breeding. All breeding partners shall be similarly certified and shall be AKC registered Akitas of Show quality.
Buyer agrees Akita will NOT be bred to any Akita who is owned/ co-owned by a known wholesaler of animals.
Buyer agrees neither this Akita or it's progeny will be sold or supplied to any owner, employee, agent or individual connected with a commercial dog center, pet shop, animal wholesaler, specialty shop, research facility, or to any person who breeds animals for and/or wholesales animals. Wholesaler meaning any individual that buys puppies in litter lots for their own resale, trades puppies for articles, sells puppies by the litter, etc. In the event this Akita or the offspring of this Akita are sold to the a fore mentioned, the Breeder SHALL take recourse through the courts for damages to her name and damage to the reputation of her bitch and her kennel name.
Buyer swears he/she is not acting as an agent in the purchase of this Akita. _______ initial

TEMPERAMENT
Seller guarantees the temperament of this Akita to be in keeping with the AKC Breed Standard as of delivery date.
Buyer acknowledges full understanding of the Akita temperament & is familiar with the Akita AKC Akita Breed Standard.
Seller has socialized this puppy from birth until delivery date and bred this Akita with the goal of a stable Akita temperament.
Buyer assumes full responsibility for the temperament of this Akita following the 72 hour period provided for examination.
The Buyer holds the Seller harmless from any and all liability for any injury or damages to person's or property caused by this Akita after the delivery date. __________ initial

GUARANTEES
Should action become necessary on the part of the Seller under the guarantee, Buyer shall have the following options
1) Sterilize the Akita. Buyer may keep Akita or place it in an approved home in compliance with Seller's application and pet contract. Upon proof of sterilization and/or placement, Seller will replace Akita with a show-quality replacement puppy selected by Seller from Seller's next available litter.
2) Sterilize the Akita and keep it. Upon proof of sterilization, Seller will refund the Buyer the difference between the actual purchase price of the Akita and the purchase price of a pet puppy from the same litter.
Seller reserves the right to have a second veterinarian of their choice evaluate the Akita's condition before honoring health guarantee.
Where a dispute arises over Show Quality, an AKC-approved judge of Akitas mutually satisfactory to both parties shall be consulted. Seller and Buyer agree to abide by such judge's decision. ________ initial

TRAINING
The Buyer agrees to properly raise, train & socialize this Akita.
The Buyer agrees to attend a Puppy kindergarten classes of at least 6 weeks duration to establish correct dog to dog interaction skills and Basic obedience classes of at least 6 weeks duration to establish pack order and correct human to dog interaction skills
Buyer agrees to attend conformation classes & fun matches for Show Training.
The Buyer agrees that said Akita will NOT be trained in attack, guard, sentry, protection, K-9 Command, Mandog, or other "police" or "protection/attack" work, whether such training is undertaken by the Buyer or any other person. ____initial

GENERAL CARE AND REQUIREMENTS
Buyer agrees to microchip this puppy during it's first vet exam.
This Akita must be allowed to co-habitate the Buyer's home on a regular basis and be integrated as part of a human family.
This Akita will not be left in a yard/kennel for extended periods without human interaction.
This Akita is not to be kept CRATED during daytime hours for more than 4 consecutive hours (up to the age of 6 months) without access to another form of containment which will allow for excersize and bowel/bladder release.
This Akita must be kept under control of the Buyer or other responsible person both on and off the Buyer's property.
This Akita must not be allowed to run loose off lead or to roam at will.
The Buyer agrees to provide routine veterinary care, Premium quality food, fresh water, safe containment/shelter, exercize, and grooming including keeping nails short and teeth maintained.
This Akita is not to be tethered by chain or rope as it's primary means of containment. _________ initial

FIRST RIGHT OF REFUSAL
Buyer shall notify Seller immediately for the first option to repurchase, if the Buyer considers selling, giving away, or co-owning this Akita with any other person(s). Seller shall have the option to repurchase this Akita at the then fair-market value of the Akita. Fair market value shall be determined by a third, mutually acceptable party. If Seller does not exercise the buyback option, Buyer must inform Seller of the name and address of the new owner. The Seller will have 21 days to determine whether they will re-purchase this Akita. Buyer may not sell any Akita from which the Seller is entitled to puppies or stud service unless Legal Provisions are made to insure Seller's rights to stud service due & puppy due. __________initial

CONTACT
Upon the death of this Akita under any circumstance and at any age, the Buyer agrees to provide prompt notice and particulars of death to the Seller.
Buyer agrees to contact Seller with any information regarding Genetic problems found in this Akita or any offspring of this Akita.
Buyer shall keep Seller informed about the Akita's progress in Dog Shows, Trials, and general health.
AKC Championship of Record copy of certificate will be sent to the Seller upon completion.________initial

PUPPIES BACK/BREEDING RIGHTS
If Akita is a MALE Seller will have STUD SERVICE RIGHTS for bitches the Seller owns or co-owns at no charge to the Seller. Seller will be responsible for all expenses to accomplish said breeding.
If Akita is a FEMALE see first page for puppy back requirements on this Akita. _______initial

SELLER AVAILABILITY
Seller agrees to be available to the Buyer for consultaion regarding the welfare of this Akita for this Akita's entire lifespan. Seller agrees to handle this Akita in the show ring if this would be of value in this Akita becoming an AKC Champion of Record. Boarding, shipping, entry fees, lodging, food and travel expenses to allow this are the responsibility of the Buyer. If Buyer desires Seller to handle this Akita as a SPECIAL further arrangements will be required regarding cost of handling in the Specials ring.___________ initial

LAW TO APPLY Both parties agree that the law of the State of Colorado shall apply to this Sales Contract and that this sales Contract shall be enforceable in Boulder County, Colorado.______initial

SERVABILITY If any provision of this Sales Contract is or becomes void or unenforceable by force or operation of law, the other provisions shall remain valid and enforceable._______initial

BUYER agrees to pay all of Breeder's court costs, legal fees (including reasonable attorney's fees) incurred by Seller while enforcing this Sales Contract.________ initial

CONTRACT AMENDMENT Any changes or additional terms to this Sales Contract must be made in the form of an Addendum and signed by all parties. __________inital
