CIVIL RIGHTS - CIVIL LIBERTIES & US SUPREME COURT
Financial assistance and legal defense fund sought for an appeal at the United States Supreme Court that involves the ability of someone to obtain an overbroad harrassment injunction that is constitutionally overbroad, and according to the case law in several states should have been vacated and considered invalid. By a fluke of a six member court at the Wisconsin Supreme Court (one justice did not sit as she had been appointed to a Federal court, but no confirmation hearings had been scheduled), the court tied 3-3 following oral arguments. This resulted in no decision at the Wisconsin Supreme Court, and my then-attorney filed a motion for reconsideration, which was denied without any opinion. I have been told by a former district attorney that this is the worst law on the books, and it is readily used for improper purposes. The Milwaukee Journal has run at least one article about the growth of the use of injunctions, and the improper use of injunctions.
I am seeking financial assistance to continue this appeal to the United States Supreme Court, which must be filed by August 12, 2004. In addition, the failure of the Wisconsin Supreme Court to act also resulted in the upholdiing of nearly $20,000 in allegedly frivilous costs for challenging an unconstituioally overbroad injunction. This is a chilling statement on the status of injunctions and restrictions on constitutional rights, and I appreciate all financial suport. The Harvard Civil Rights project site gets between 600,000 and 800,000 hits a month --- so civil rights and civil liberties is a topic of interest to many. The way the law is now, someone can easily seek an injunction under false pretenses, as the Milwauakee Journal article stated judges dish these out like candy, regardless of the law or the case law. It is rare for an appeal to go this far....but it must go farther.
