PET AKITA SALES CONTRACT

REGISTRATION/SPAY-NEUTER CLAUSE
*Buyer agrees to spay/neuter Akita no later than 8 months of age & send copy of receipt to Seller.
*Seller agrees to transfer AKC registration papers to the Buyer upon full payment of purchase price of Akita and within 30 days of receipt of proof of spay/neuter surgery.
*Cold Mountain prefix will be used on AKC registered name.
*Akita will be AKC registered by no later than 10 months of age.
*Copy of AKC registration papers will be sent to Seller.
The Akita will have LIMITED AKC registration which means the Akita cannot be bred . ________ initial

HEALTH
Seller certifies that the Akita is in good health. The Akita was free of health defect or disease at the following exam:

Health records including vaccines and wormings will accompany the Akita.
Upon receipt the buyer shall have the Akita examined by a veterinarian at the Buyer's expense. If Akita is found to have disease or defect in any way Buyer agrees to notify Seller immediately. Buyer may return the Akita for a refund of the purchase price, less the deposit, within 72 hours of receipt of the Akita. Return of the Akita will be at the Buyer's expense. ________ initial

HEALTH GUARANTEE
Seller guarantees that at the age of 12 months, the Akita will be free of genetically caused hip, elbow, or patella dysplasia. If Akita exhibits symptoms of problems in this area it shall be xrayed and radiograph examined by the Orthopedic Foundation for Animals (hereinafter, "OFA") at the Buyer's expense.
Seller guarantees that at the age of 12 months, the Akita will be free of Progressive Retinal Atrophy (PRA). If Akita exhibits symptoms of problems in this area it shall be examined by a veterinary opthamologist as so registered by the Canine Eye Registration Foundation (hereinafter, "CERF") at the Buyer's expense
Written documentation providing the diagnosis of dysplasia or PRA through OFA and/or CERF will be provided to the Seller.
Seller reserves the right to have a second veterinarian of their choice evaluate the Akita's condition before honoring the health guarantee to determine if the above conditions are of environmental cause (ie the result of malnutrition, accident, illness or any other non-genetic etiology) or are of genetic cause.
If the above are found to be genetic in origin the Buyer shall have the following options:
Buyer will continue to provide a home for the Akita and the Seller will refund 50% of the purchase price of the Akita.
OR
Buyer will continue to provide a home for the Akita and the Seller will provide the Buyer with another pet quality Akita from Seller's next available litter at 50% of purchase price of a pet puppy from the same litter. __________ initial

PREVENTATIVE QUARANTINE
Buyer agrees that the Akita will not be taken into areas potentially hosting PARVO or other infectious diseases for 2 (two) full weeks after Akita has been delivered to Buyer. This includes but is not limited to hiking trails, dog parks, fun matches, dog shows, doggie daycare centers, pet stores, training centers, and/or any areas where large numbers of dogs are known to congregate.
If puppy is being transferred via auto to it's new home-it is the full responsibility of Buyer to insure that this puppy is not entering areas where PARVO or other infectious diseases is active during transport. Especially avoid roadside parks along major expressways. This information can be found by calling Emergency Animal Care Centers in the areas where puppy will be visiting during transport. Such Centers will reveal if PARVO and other infectious diseases are a problem in that area and how many cases are typical of that season. Such Centers will reveal which areas in a certain County (including Buyer's own County) are known to be creating active Parvo cases. _________ initial

TEMPERAMENT
Seller guarantees the temperament of this Akita to be in keeping with breed temperament as described in the AKC Akita Breed Standard as of the signing of this contract.
Buyer acknowledges full understanding of the characteristics of the Akita breed & is familiar with the AKC Akita Breed Standard regarding temperament.
Seller has socialized this Akita from birth and bred this Akita with the goal of a stable temperament.
The Buyer assumes full responsibility for the temperament of this Akita following the 72 hour period provided for examination.
The Buyer agrees to continue life long socialization of this Akita from date of purchase.
The Buyer, by the covenants contained herein agrees to hold the Breeder HARMLESS from any and all liability for any injury or damage to persons or property caused by this Akita.
The Buyer agrees to study canine behavior and socialization to provide a stable, permanent home for this Akita. ______initial

TRAINING
Seller REQUIRES that Buyer and all resident family members attend & graduate from a 6-8 week GROUP Puppy Kindergarten class and a 6-8 week GROUP Basic Obedience class. Puppy kindergarten to begin upon end of 2 week quarantine period. Basic Obedience series to begin no later than one month after end of puppy kindergarten series.
Seller agrees to refund to the Buyer $25 upon receipt of Certificate of Graduation & photo from kindergarten series and $25 upon receipt of Certificate of Graduation & photo from obedience series.

The Buyer agrees that this Akita will not be trained in attack, guard, sentry, protection, K-9 Command, Mandog or other "Police" or "Protection/Attack" work.

This Akita will be kept under control of the Buyer or other responsible adult both on and off the Buyer's property.

This Akita shall NOT be allowed to run loose or roam at will. The Buyer agrees that this Akita will always be ON LEAD and under the Buyer's control. _____ initial

GENERAL CARE & REQUIREMENTS
Akita is to be microchipped and be registered with CAR (Canine Animal Recovery) at it's first vet visit. Breeder will be listed as alternative contact in case puppy is lost.
If Akita is confined within a RUN that structure must not be less than 5' wide x 15' long by 6' high.
If Akita is confined within a YARD fence height MUST BE 6 feet or more in height.
Provisions must be met that will keep this Akita from climbing over or digging out of yard or run.
No Underground fences as they allow other animals/children to enter
Provisions for shade & shelter from the elements must be made.
Akita will be allowed to co-habitate the Buyer's home on a regular basis.
Akita will not be left out in a fenced yard or kennel for extended periods without human interaction.
Akita must NOT be kept crated more than 4 (four) consecutive daytime hours without access to bowel/bladder release and excersize, until puppy is 6 months of age. Please arrange for someone to excersize the puppy if you will be unavailable to do so yourself.
Premium or RAW dog food with fresh water available at all times
Routine grooming including brushing, toenail care & teeth maintenance
Routine Vet Care
Buyer agrees that this Akita shall not be allowed to ride free in an open bed truck.
THIS AKITA MUST NEVER BE BRED. _______ (initial)
ACCIDENTAL BREEDING CLAUSE The Buyer agrees not to sell the Akita or any of it's offspring to any commercial dog center, pet shop, animal wholesaler, research facility, or to any person who breeds animals for and/or wholesales animals of any age to any of the above. Wholesaler meaning any individual that buys puppies in litters for their own resale, trades puppies for articles, sells puppies by the litter, etc. In the event that the Seller discovers that the Buyer does sell this Akita or this Akita's offspring to the afore mentioned, the Breeder shall take recourse throught the courts for DAMAGES to her name and damage to the reputation of Seller in the amount of $3,000.

CHANGE OF OWNERSHIP
Buyer agrees that if at any time or for any reason he/she is unable to keep this Akita, considers selling, giving away, or co-owning this Akita Seller will be contacted BEFORE any action is taken as Seller retains First Right Of Refusal. Seller agrees to assist Buyer in re-homing this Akita. Buyer agrees not to allow this Akita to go homeless, be placed in a shelter, or be placed in an inappropriate home. _____ initial

CONTACT
Buyer will notify Seller upon the death of this Akita with the particulars of the death.
Buyer will notify Seller with any change of address during the lifespan of this Akita.
Buyer agrees to keep monthly contact with the Breeder for the first year of this Akita's life and at least yearly contact after that.
Buyer agrees to notify Breeder immediately with documentation of any genetic issues that arise with this Akita.
Buyer will keep the Seller informed about the Akita's progress throughout it's life. ________ initial

CONTRACT ENFORCEMENT
Buyer agrees to pay all Seller's court costs, legal fees (including reasonable attorney's fees) incurred by Seller while enforcing this Sales Contract.
Both parties agree that the law of the State of Colorado shall apply to this Sales Contract and that this sales Contract shall be enforceable in Boulder County, Colorado.
If any provision of this Sales Contract is or becomes void or unenforceable by force or operation of law, the other provisions shall remain valid and enforceable.
Any changes or additional terms to this Sales Contract must be made in the form of an Addendum and signed by all parties.

SELLER AVAILABILITY
Seller agrees to be available to the Buyer for consultaion regarding the welfare of this Akita for it's lifespan.

THIS CONTRACT constitutes the entire understanding of the Buyer and Breeder and supersedes any previous agreements, written or oral.
